Ban on ‘Made-in-Pakistan’ Sharbat being sold on Amazon in the name of ‘Rooh Afza’, haven’t you bought it?

You must have heard the name Rooh Afza and if not, then let us tell you that Hamdard’s Rooh Afza has been the favorite drink of Indians for decades. Hamdard earns more than 200 crores annually from this brand name. From this you can guess how much this sherbet would be sold. Obviously, there must be piracy of such a popular drink. One such latest incident has come to the fore, where a Pakistani sherbet is being sold in India by the name of Rooh Afza. Now, the Delhi High Court has restrained retailers on e-commerce platform Amazon from selling sharbat made in Pakistan under the brand ‘Rooh Afza’.

NDTV’s accordingThe court’s decision came after a complaint by Hamdard National Foundation (India), where the company claimed that sharbat manufactured in Pakistan was sold under the company’s brand name in India. Please tell that ‘Rooh Afza’ is a brand owned by Hamdard Company in India.

The High Court ruled in favor of Hamdard, which had issued the trademark ‘Rooh Afza’ in 1907. The company sells products worth more than Rs 200 crore annually under this brand name.

The report states that Justice Pratibha Singh also said that if any other matter is found to be infringing the ‘Rooh Afza’ trademark of the plaintiff (Hamdard), it will be brought to the notice of Amazon India and it will be notified under Information Technology (Intermediary Guidelines) and Digital Media Code of Conduct) will be removed as per law.

Hamdard National Foundation (India) and Hamdard Dawakhana had claimed that a company named Golden Leaf was selling its products on Amazon India under the trademark ‘Rooh Afza’. Further, it was also informed that three purchases were made by him through Amazon platform from three retailers and all the products were manufactured by Hamdard Laboratories (Waqf) Pakistan.
